Terms & Conditions

1. Who we are
FolioPress is a website and blog builder with translation built in, operated by M. Marcos ("FolioPress," "we," "us," or "our"), based in the European Union. These Terms of Service ("Terms") govern your access to and use of FolioPress's hosted service (the "Service").
By creating an account or otherwise using the Service, you agree to these Terms. If you're using the Service on behalf of an organization, you confirm you're authorized to accept these Terms on its behalf, and "you" refers to that organization.
2. Eligibility and accounts
You must be at least 16 years old (or the age of digital consent in your country, if higher) to create an account, and at least 18 (or the age of majority in your country) to buy a subscription.
You're responsible for giving us accurate information, keeping your sign-in credentials secure, and all activity under your account. Tell us promptly at support@foliopress.io if you suspect unauthorized access.
3. The Service
FolioPress provides hosted websites and blogs that you create, edit, and publish in multiple languages, including optional AI-assisted translation, summarization, and proofreading. Each site is available at a FolioPress subdomain (for example, yoursite.foliopress.io). We may add, change, or remove features over time, and we'll give reasonable notice of changes that materially reduce what your plan includes.
4. Your content
You keep all ownership rights to the content you create, upload, or publish through the Service ("Your Content"). You grant us a limited, non-exclusive license to host, store, copy, process, translate, and display Your Content only as needed to operate and provide the Service to you and to your site's visitors. This license ends when Your Content is deleted from the Service, except for copies in backups, which are deleted on their normal rotation.
You're responsible for Your Content and for having the rights needed to publish it. You can ask us for a copy of Your Content at any time by writing to support@foliopress.io.
5. AI-assisted features
FolioPress includes optional AI features (translation, summarization, proofreading) that generate suggestions based on content you provide. These are suggestions only: nothing is published without your explicit action, and you're responsible for reviewing AI-generated text before publishing it, including its accuracy in each language. We don't use Your Content to train AI models.
6. Plans, trials, and payment
Merchant of record. Payments are processed by our reseller and merchant of record, Polar (polar.sh). When you buy a subscription, you buy it from Polar, which handles payment, invoicing, and sales tax, and Polar's own terms also apply to the purchase.
Prices and taxes. Prices are shown in euros. For customers in the EU, the UK, and most other countries, the price shown includes VAT or equivalent tax. For customers in the United States, Canada, and India, applicable sales tax is added at checkout. The final amount, including any tax, is always shown before you pay and itemized on your receipt.
Free trial. New subscribers get a free trial of the length shown at checkout (currently 30 days), available once per customer. You won't be charged until the trial ends, and you can cancel at any time during the trial without paying anything.
Renewal and cancellation. Subscriptions renew automatically at the end of each billing period (monthly or yearly) until you cancel. You can cancel at any time from your billing settings or by writing to us; cancellation takes effect at the end of the current billing period, and your site stays online until then.
Price changes. We'll tell existing subscribers about a price change at least 30 days before it applies to them. If you don't agree, you can cancel before your next renewal.
Refunds. Apart from your right of withdrawal (Section 7) and any rights you have under applicable law, fees already paid for a billing period that has started are not refundable.
7. Right of withdrawal (consumers in the EU, EEA, and UK)
If you're a consumer in the EU, the EEA, or the UK, you have the right to withdraw from your subscription within 14 days without giving any reason. The withdrawal period runs for 14 days from the day the contract is concluded (the day you start your subscription or trial).
To exercise this right, send us a clear statement of your decision to withdraw before the period ends, for example by email to support@foliopress.io (for instance: "I hereby withdraw from my contract for the FolioPress subscription for the site [subdomain], concluded on [date]. Name, account email."). Cancelling during the free trial has the same effect.
If you withdraw, we'll refund all payments received from you, without undue delay and no later than 14 days from the day we receive your withdrawal, using the same payment method you used (refunds are issued through Polar). You won't be charged any fees for the refund. Because the Service starts immediately at your request, if you withdraw after a paid period has begun, we may keep an amount proportionate to the service provided until you told us of your withdrawal; during the free trial that amount is zero.
8. Acceptable use
You agree not to:
- Use the Service to break any applicable law or to publish illegal content;
- Infringe anyone's intellectual property, privacy, or other rights;
- Publish content that is fraudulent, defamatory, hateful, harassing, sexually exploits minors, or promotes violence;
- Send spam, host phishing pages, or distribute malware;
- Try to disrupt the Service, gain unauthorized access to it or to other users' accounts, or place an unreasonable load on it;
- Resell the Service, or reverse-engineer it except where the law allows, without our written permission.
9. Suspension and termination
You can stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the Service or others, with notice and a chance to fix the problem where reasonably possible. Independently of account termination, we may disable or remove any site or content that we reasonably believe is illegal or harmful.
When your subscription ends, we may take your site offline and, after giving you reasonable notice and a chance to request a copy of Your Content, delete it. Provisions that by their nature should survive (ownership, disclaimers, limitation of liability, governing law) survive termination.
10. Our intellectual property
The Service, including its software, design, name, and logo, belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable license to use the Service as allowed by these Terms. The themes and software you use through the Service remain ours or our licensors'; Your Content remains yours.
11. Availability and disclaimers
We work to keep the Service secure, available, and backed up, but we don't guarantee that it will be uninterrupted or error-free, or that AI-generated suggestions will be accurate. To the extent permitted by law, the Service is provided "as is" and "as available." If you're a consumer, this doesn't affect your statutory rights regarding the conformity of digital services.
12. Limitation of liability
To the extent permitted by law, we're not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for all claims relating to the Service or these Terms is limited to the greater of the amount you paid for the Service in the 12 months before the claim or €100.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for intentional or grossly negligent conduct, or any other liability that can't be limited or excluded by law, including your mandatory rights as a consumer.
13. Governing law and disputes
These Terms are governed by the laws of Portugal. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring proceedings in the courts of that country. Before going to court, please contact us at support@foliopress.io so we can try to resolve the issue informally. Consumers can also use an alternative dispute resolution body under their local law.
14. Changes to these Terms
We may update these Terms from time to time. We'll post the updated Terms here with a new "Last updated" date and, for material changes, notify account holders by email at least 30 days before they take effect. If you don't agree with the changes, you can cancel before they apply.
15. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. If any part of them is found unenforceable, the rest stays in effect. Not enforcing a provision isn't a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer them as part of a transfer of the Service, provided your rights aren't reduced. Neither party is liable for delays caused by events beyond its reasonable control.
